Terms and Conditions of Sale and Use

2. Scope of Application

These Terms apply to purchases made on www.pixuprint.net, currently relating to downloadable digital products such as graphic files, illustrations, and digital content intended for personal use.

PixuPrint may in the future introduce physical print-on-demand products or printing services through third-party partners. In such case, these Terms will be updated before the service becomes active.

In the event of conflict, the conditions displayed at checkout for the specific order shall prevail.

3. Age Requirements and Eligibility

Use of the Website and purchases are reserved for adults. Minors under 18 years old may purchase only with the consent of a parent/legal guardian.

Minimum age to access the Website: 14 years old.

By placing an order, you declare that you meet the requirements and have the legal capacity to enter into binding contracts.

4. Products and Availability

  • Digital products: files available for download after payment, according to the methods indicated on the product page and/or confirmation email.

  • Images are for illustrative purposes only: colors, rendering, and proportions may vary depending on monitors, devices, software, printers, paper, and printing services used by the Customer.

  • No physical product is shipped unless expressly indicated on the product page or during checkout.

5. Order Process

Before payment, you will see the order summary and prices. After payment, you will receive confirmation by email and, where applicable, the link or instructions to download the purchased files.

PixuPrint may refuse or cancel orders in case of suspected fraud, obvious pricing/description errors, technical issues, or service unavailability. In such cases, any amounts paid will be refunded.

6. Prices, Taxes, and Payments

  • Prices are in Euro (€), VAT included where applicable.

  • Accepted payment methods: Stripe and PayPal, where available at checkout. Stripe supports credit/debit cards and other digital payment methods available depending on the country. PayPal allows payment through PayPal accounts and other methods supported by the platform.

  • Charges are applied upon order confirmation.

  • Any currency conversion costs/banking fees remain the responsibility of the Customer.

  • For purchases with a VAT Number: please enter the details during checkout or request an invoice via email.

7. Digital Products: Download and Support

  • Download links or access instructions for the files are provided after payment.

  • The Customer is responsible for downloading, storing, and backing up purchased files.

  • For access issues, broken links, or corrupted files, please contact PixuPrint within 7 days from purchase.

  • PixuPrint may regenerate or resend the download link whenever technically possible, after order verification.

8. Self-Printing of Files

  • Digital files may be printed by the Customer for personal use through online services, print shops, copy centers, or home printers.

  • PixuPrint is not responsible for the final quality of prints made by third parties or by the Customer, including color differences, paper choice, format, trimming, margins, or printing settings.

  • Any indications regarding formats, resolution, or aspect ratio are provided to facilitate printing, but do not guarantee identical results on every device or printing service.

9. Possible Future Printing Services

PixuPrint may in the future offer physical print-on-demand products through third-party production and logistics partners such as Printful or similar services.

Such services are not active unless expressly indicated on the product page or at checkout. Before activation, these Terms will be updated with information regarding production, shipping, delivery, returns, and responsibilities applicable to physical products.

10. Right of Withdrawal and Refunds

  • Digital products: the right of withdrawal is excluded pursuant to Art. 59, letter o) of the Italian Consumer Code when you request immediate execution of the contract and accept losing the withdrawal right once the download or digital supply begins.

  • Refunds are not accepted for change of mind, incorrect purchase, incompatibility with software/devices not specified, color, format, or personal preferences, except in cases of lack of conformity or technical issues attributable to PixuPrint.

  • In the event of an incorrect, corrupted, or inaccessible file due to causes attributable to PixuPrint, the Customer may request assistance, file replacement, or refund, subject to verification.

Explicit checkout acceptance clause: by proceeding with the order, you acknowledge that for digital products, by requesting immediate supply, you lose the right of withdrawal once the download or digital supply has started; any remedies are limited solely to defects of conformity or verifiable technical issues.

11. Defects and Warranties

  • Consumers: the legal guarantee of conformity provided by the Italian Consumer Code applies, where applicable to digital content and services.

  • B2B: the rules of the Italian Civil Code apply.

  • For corrupted, unusable, or incorrect files, the Customer should contact PixuPrint preferably within 7 days from purchase, attaching the order number and a description of the issue.

Remedies: file replacement, resend of the download link, or refund, subject to verification of the issue.

12. Licenses and Intellectual Property

  • The Website, contents, graphics, images, texts, mockups, and materials are owned by PixuPrint or their respective owners.

  • Digital products: personal, non-exclusive, non-transferable license for private/non-commercial use only, unless otherwise stated on the product page.

  • Printing files for personal use, even multiple times, is permitted.

  • Resale, redistribution, public sharing of files, sublicensing, uploading to marketplaces or download platforms, commercial use, modification for resale, removal of watermarks or attributions, and creation of physical products intended for sale are prohibited.

13. Limitation of Liability

  • Maximum liability is limited to the amount paid for the relevant order, within the limits permitted by law.

  • No liability for indirect damages, loss of profit, data, or opportunities, except in cases of willful misconduct or gross negligence.

  • PixuPrint is not liable for service interruptions caused by third parties, payment platforms, email services, hosting providers, printing services independently chosen by the Customer, or force majeure events.

14. Governing Law, Jurisdiction, and ADR/ODR

  • Applicable law: Italian law.

  • Exclusive jurisdiction: Turin, Italy, except as otherwise provided by mandatory consumer protection regulations.

  • EU consumers retain the right to bring proceedings before the court of their place of residence (Art. 66-bis Italian Consumer Code).

  • EU ODR Platform: https://ec.europa.eu/consumers/odr.

  • PixuPrint is open to amicable dispute resolution attempts.

15. Severability Clauses

  • If any provision is null/unenforceable, the remaining provisions shall remain valid.
  • Failure to exercise a right does not constitute waiver.
  • No liability for delays or failures caused by force majeure or events beyond reasonable control, including strikes, disasters, interruptions of third-party services, technical issues, blackouts, or malfunctions of external platforms.
  • In the event of discrepancies between translations and the Italian version, the Italian version shall prevail.

16. Changes to the Terms

PixuPrint may update these Terms for legal, technical, or operational reasons. Changes will be communicated on the Website and, if significant, by email with reasonable notice.
