Terms and Conditions of Sale and Use

1. Operator Identity

  • Production/Shipping: entrusted to third-party production and logistics partners. PixuPrint remains the sole contractual counterpart for the Customer.

2. Scope of Application

These Terms apply to purchases made on www.pixuprint.net relating to: (a) downloadable digital products; (b) physical products printed on demand.

In case of conflict, the conditions shown at checkout for the specific order prevail.

3. Age and Eligibility Requirements

Use of the Website and purchases are reserved for adults. Minors under 18 may purchase only with the consent of a parent/guardian.

Minimum age for access to the Website: 14 years.

By placing an order, you declare that you meet the requirements and have the legal capacity to enter into binding contracts.

4. Products and Availability

  • Digital: files/licenses available for download after payment.

  • Print-on-demand: produced ad hoc upon receipt of the order; not kept in stock.

    Images are illustrative: colors, rendering, and proportions may vary due to technical limits of monitors/printing.

5. Ordering Process

Before payment you will see an order summary and prices. After payment you will receive confirmation by email.

PixuPrint may refuse or cancel orders in cases of suspected fraud, obvious errors in prices/descriptions, or unavailability of service. In such cases, any amounts already paid will be refunded.

6. Prices, Taxes, and Payments

  • Prices are expressed in euros (€), VAT included where applicable.

  • Accepted methods: Stripe (credit/debit cards). PayPal may be added in the future.

  • Charges are made at the time of order confirmation.

  • Any currency conversion fees or bank charges are borne by the Customer.

  • For purchases with VAT number: enter the data at checkout or request an invoice via email.

7. Production, Shipping, and Delivery (Printed Products)

  • Production and delivery are managed through third-party partners selected by PixuPrint.

  • Shipping times and costs are indicated at checkout and vary by destination and product.

  • Times are indicative: delays due to couriers, customs, or force majeure do not entail liability, except in cases of willful misconduct or gross negligence.

  • Non-delivery/warehouse storage due to incorrect address or absent recipient: the Customer bears the costs of re-shipment.

  • The risk of loss/damage passes to the Customer upon delivery.

8. Digital Products: Download and Support

  • Download links are provided after payment.

  • The Customer is responsible for storing downloaded files independently.

  • For access problems or corrupted files, contact PixuPrint within 7 days of purchase.

9. Right of Withdrawal and Returns

  • Print-on-demand: goods produced ad hoc; the right of withdrawal is excluded under Art. 59, letter c) of the Consumer Code (customized or clearly personalized goods).

  • Digital products: the right of withdrawal is excluded under Art. 59, letter o) of the Consumer Code when you request immediate execution and accept the loss of the right upon start of download/supply.

  • Returns are not accepted for change of mind, color, format, size, or similar.

Explicit acceptance clause (checkout): by placing the order you acknowledge that (i) for digital products, requesting immediate supply waives your right of withdrawal; (ii) for print-on-demand products the right of withdrawal does not apply; (iii) remedies are limited to non-conformity defects only.

10. Defects, Damage, and Warranties

  • Consumers: 2-year statutory warranty of conformity (Arts. 128–135 Consumer Code).

    Covered: manufacturing defects, damage, or discrepancies with the order. Not considered defects: slight color variations due to printing techniques and minor cutting tolerances (≈2–3 mm).

  • B2B: ordinary Civil Code rules apply.

To report defects/damage:

  • Printed products: to promptly activate claims with logistics partners, please report transport damage or evident defects preferably within 72 hours of delivery, attaching photos of product, packaging, and label (without prejudice to statutory rights).

  • Digital products: report corrupted/unusable files preferably within 7 days.

Remedies: replacement/reproduction or proportional refund, subject to verification.

Printing tolerances: slight color variations and minor cutting deviations (≈2–3 mm) do not constitute a defect.

11. Licenses and Intellectual Property

  • Website, content, and materials are owned by PixuPrint or their respective holders.

  • Digital products: personal, non-exclusive, non-transferable license, for private/non-commercial use only (unless otherwise stated). Resale, redistribution, sublicensing, or watermark removal is prohibited.

  • Printed products: intended for personal use; no further reproductions authorized.

12. Limitation of Liability

  • Maximum liability limited to the amount paid for the relevant order.

  • No liability for indirect damages, loss of profit, data, or opportunities, except in cases of willful misconduct or gross negligence.

  • PixuPrint is not liable for disruptions caused by third parties (couriers, payment platforms, printing partners) or force majeure.

13. Applicable Law, Jurisdiction, and ADR/ODR

  • Applicable law: Italian.

  • Exclusive jurisdiction: Turin, Italy.

  • For EU consumers, the right to bring claims before the court of residence remains unaffected (Art. 66-bis Consumer Code).

  • EU ODR platform: https://ec.europa.eu/consumers/odr.

  • PixuPrint is open to amicable dispute resolution attempts.

14. Safeguard Clauses

  • If any provision is found void/ineffective, the remaining provisions remain valid.
  • Failure to exercise a right does not constitute a waiver.
  • No liability for delays or non-performance due to force majeure or events beyond reasonable control (strikes, natural disasters, third-party service interruptions).
  • In case of conflict between this translation and the Italian version, the Italian version prevails.

15. Changes to the Terms

PixuPrint may update these Terms for legal or operational reasons. Changes will be communicated on the Website and, if relevant, by email with reasonable notice.
